The petitioner is apprehending his arrest in a case registered under Sections 419, 354(a)(II) of the Indian Penal Code and Section-37(a) of the Bihar Prohibition and Excise Act, 2016. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses against the petitioner. The informant is a private party and due to political rivalry, he got instituted the present case. The petitioner is the Chairman of Sonepur Municipality and the informant is brotherin-law of the Ward Commissioner. The present prosecution is offshoot of the political rivalry. There is no recovery of liquor in present case.
Patna High Court Cr.Misc. No.35193 of 2018 (3) dt.20-07-2018 On behalf of the State and O.P. No. 2, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-VI, Saran at Chapra in connection with Sonepur P.S. Case No. 428 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
