JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Darihat P.S. Case No. 65 of 2019 registered for the offences punishable under Sections 30(a) and 37(c) of the Bihar Prohibition and Excise Act.

As per FIR police on confidential information reached near the house of the petitioner and saw one person with Hero Honda motorcycle and seeing the police party he left the motorcycle and fled away and village Chaukidar has identified the person as petitioner. It is alleged that 12.240 litres were recovered from the said motorcycle.

Submission of learned counsel for the petitioner is that he has falsely been implicated, having no criminal antecedent and he has no concerned with the liquor. Heard learned APP, who has opposed the prayer for

Patna High Court CR. MISC. No.73341 of 2019(2) dt.20-11-2019 2/2 anticipatory bail stating that motorcycle was recovered from in front of house of the petitioner and his name was disclosed by local Chaukidar.

In view of above facts and circumstances, this application is disposed of with direction to the petitioner to surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.
