Learned counsel appearing on behalf of the petitioner has questioned the alleged illegal action of the Block Development Officer, Chakia, who had allegedly, has proceeded to relocate the site for constructing the Panchayat Sarkar Bhawan at village Korigawa in place of the headquarter village Mahuwawa. He submits that same is not in accordance with government's guidelines.
3. Considering the relief(s) sought for in the present
Patna High Court CWJC No.17324 of 2023(2) dt.08-01-2024 2/2 writ petition, the District Magistrate, East Champaran, is directed to call for the records from the Circle Officer, Chakia, as well as, from the Block Development Officer, Chakia and see that adequate government land is available at the headquarter village as claimed by the petitioner. Upon investigation he is satisfied that land is available then in that case he may take action against the Block Development Officer, who has impeaded the development work with respect to the construction of Panchayat Sarkar Bhawan at the headquarter village. In case, it is found that his action is malafide, he may recommend for appropriate disciplinary action against the Block Development Officer or any of the concerned officer of the Block.
4. The District Magistrate, East Champaran, must ensure to take appropriate steps to proceed with the development work of construction of the Panchayat Sarkar Bhawan at the appropriate site as determined by him expeditiously in accordance with the circular of the State Government.
5. Accordingly, the present writ petition is disposed of.
