The petitioner seeks anticipatory bail in a case instituted for the offences under Sections 379 and 411 of the Indian Penal Code and Section 4/40 of B.M.M.C. Rule 1972.
As per allegation a tractor along with trailer loaded with stone chips was intercepted, it was found that he was carrying the same with proper documents. The tractor and trailer was seized and later on released in favour of the petitioner after death of his brother as the tractor and trailer was in the name of his brother.
Learned counsel for the petitioner submits that in the present case the petitioner has been implicated when he has
Patna High Court Cr.Misc. No.37503 of 2018 (2) dt.05-07-2018 2 /2 filed an application for release of the vehicle at the behest of wife of his brother who authorized him to get the vehicle released. Further said that he has no concerned with the tractor and trailer. Save and except petitioner has helped to the family members of the deceased.
Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioner, namely, Amrendra Kumar, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, 1st, Munger in connection with East Colony P.S. Case No.29 of 2018, G.R. No. 1090 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Shivaji Pandey, J) Vinay/- U T
