The petitioners seek pre-arrest bail in connection with Karagahar P.S. Case No. 146 of 2019 registered under Sections 323, 341, 307, 379, 504, 506 and 34 of the Indian Penal Code. The accusation is that Jai Prakash Singh, nephew of the informant, Madan Singh, was going along with his wife at the examination center of his wife. In the way, villager, Jai Prakash Singh, misbehaved due to that reason informant along with others went at the house of Jai Prakash Singh to make complaint in the evening of 30.05.2019, Jai Prakash Singh, Radhe Shyam Singh and Sipahi Singh started to abuse the informant. Radhe Shyam Singh gave the iron rod blow at his head. Sipahi Singh also caused injury to his brother, Madan

Patna High Court CR. MISC. No.73131 of 2019(2) dt.21-11-2019 2/2 Singh. At that time, Jai Prakash Singh also caused injury through the butt of the pistol at the head of Madan Singh. In that course they also snatched the gold chain worth Rs.3,000/- and cash Rs.5,000/-.

Submission is that due to petty dispute occurrence of Maar-peet took place. Moreover, the injuries of informant and his father are of simple in nature. Both the petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of arrest/surrender, within a period of four weeks from today, in connection with Karagahar P.S. Case No. 146 of 2019 shall be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, III, Rohtas at Sasaram, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
