====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-04-2025 Heard learned counsel for the petitioner and Mr. Umeshanand Pandit, learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 148, 341, 323, 324, 379, 307, 302, 120(B) of the Indian Penal Code.
3. As per the prosecution case, on the alleged date of occurrence, on the orders of co-accused Harendra Ray, another co-accused Lalu Rai assaulted on the head of informant's husband with Farsa and when other family members of informant came to save him, the accused persons also assaulted them.
4. Learned counsel for the petitioner submits that as per F.I.R. itself, specific accusation of assault is against coaccused Lalu Rai. So far as this petitioner is concerned, there is general and omnibus allegation. Case and counter case.
Patna High Court CR. MISC. No.80655 of 2024(3) dt.03-04-2025 2/2 Similarly situated co-accused namely Harendra Rai and Lalita Devi have already been granted anticipatory bail by this Court, vide orders annexed as Annexure 2 series to the petition. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st class, Saran at Chapra in connection with Awtar Nagar P.S. Case No. 112 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
