JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2020 This is an application for grant of anticipatory bail in connection with Uchkagaon P. S. Case No. 156 of 2016, disclosing offence under Sections 47 and 49 of the Bihar Prohibition and Excise Act, 2016.

Recovery of liquor from the house of the petitioner and also from the house of the other co-accused. Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case. Nothing has been recovered from inside his house. He has no criminal antecedent.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground of recovery. Having heard both sides, considering the submissions, made above, this application is disposed of with a direction to

Patna High Court CR. MISC. No.72454 of 2019(2) dt.17-01-2020 2/2 the petitioner to surrender and pray for regular bail, the same shall be considered on its own merit, without being prejudiced by order of this Court, and if, possible to be disposed of on the same day.
