2. The petitioners apprehend their arrest in a case registered for the offence under Sections 341, 448, 506, 323, 324, 380 and 307/34 of the Indian Penal Code.

3. As per the prosecution case, on 17.05.2023 a 7:30 AM, while the informant was doing construction work on the land, it is alleged that these petitioners alongwith co-accused Dhanwantri Devi began to dismantle the pillar and wall and on protest, petitioner no. 1 assaulted with Farsa on the head of informant, whereas, petitioner no. 2 assaulted with Farsa and rod to Manoj Yadav. Petitioner no. 3 assaulted with lathi on the head of Sudhira Kumari.

4. It is submitted on behalf of petitioners that the present case is counter blast of Sakatpur P.S. Case No. 42 of 2023, which was lodged by petitioner no. 1 against informant and his family members, which is earlier in point of time. The present case has been lodged after 15 days of the occurrence without any plausible explanation of delay. Injures are simple in nature.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the delay in the lodging the F.I.R. and nature of injury, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Darbhanga in connection with Sakatpur P.S. Case No. 43 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
