The petitioner is languishing in custody since 23.08.2019 in a case registered for the offence punishable under Section 379 of the Indian Penal Code.

On theft being committed of electric motor pipe, hand pump head and switch board, FIR was lodged against Rambabu Paswan and 5 others. The name of the petitioner sprang up during investigation and on his statement the recovery of stolen articles were made from co-accused Rahul Kumar. It is submitted by learned counsel for the petitioner that the petitioner is not having any criminal antecedent statement to that effect has been made in paragraph 3 of the petition and investigation has already been concluded.

Patna High Court CR. MISC. No.70837 of 2019(2) dt.27-11-2019 2/2 Learned APP submits that the name of the petitioner sprang up during investigation and on his statement recovery has been made.

Considering the fact that the investigation has already been concluded and statement being made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Vaishali at Hajipur in connection with Goraul P.S. Case No. 246 of 2019.
