04-12-2019 Heard learned counsel for the parties.

The petitioners apprehend their arrest in Chand P.S. Case No. 153 of 2019 registered for the offence under Sections 341, 342, 323, 324, 307, 504, 34 of the Indian Penal Code. As per F.I.R., petitioners have assaulted the informant and his son by Garasa and Lathi.

It is submitted on behalf of petitioners that petitioners have falsely been implicated in this case, due to previous enmity. It is further submitted that the injuries found on the person of the informant and his son are simple in nature. It is also submitted that one of the co-accused namely Durga Kewat has already been granted anticipatory bail by this Court, vide order dated 25-10-2019 passed in Cr.Misc. No. 68629 of 2019. Besides, petitioners have got no criminal antecedent, which fact

Considering the aforesaid facts and circumstances as well as nature of accusation, in the event of arrest or surrender within a period of six weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - IV, Kaimur at Bhabua in connection with Chand P.S. Case No. 153 of 2019 on the following conditions:

(1) Petitioners shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on their absence on two consecutive dates without sufficient reason, their bail-bonds shall be cancelled by the Court below.

(2) If the petitioners tamper with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
