Petitioner is apprehending his arrest in connection with Salkhua P.S.Case No.108 of 2019 , registered for offences punishable under Sections 363, 366A and 34 of the Indian Penal Code.

As per FIR, there is allegation of kidnapping against the petitioner of minor daughter of the informant. Submission of the learned counsel for the petitioner is that her statement under Section 164 Cr.P.C. as well as Annexure 3 clearly disclose that she had married with the petitioner and she has been released from the remand home in favour of the petitioner.

Heard learned A.P.P. also.

No.69727 of 2019(3) dt.13-12-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-IV, Saharsa in connection with Salkhua P.S.Case No.108 of 2019 subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
