JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 28-06-2018 Heard learned counsel for the petitioners, learned Additional Public Prosecutor for the State and learned counsel for the informant.

The petitioners seek pre-arrest bail in connection with Choutham P.S. Case No. 26 of 2018 registered under Sections 147, 341, 342, 323, 307, 379, 504 & 506 of the Indian Penal Code. Subsequently, Section 302 of the Indian Penal Code was added. Considering the gravity of the offences and allegation against the petitioners and others that they assaulted the son of the informant with bamboo pieces, as a result of which he, initially, sustained grievous injuries and died in course of

Patna High Court Cr.Misc. No.35290 of 2018 (2) dt.28-06-2018 2/2 treatment, I am not inclined to grant them pre-arrest bail. Accordingly, the application for grant of pre-arrest bail is rejected.

However, in case the petitioners surrender and seek bail, the same shall be considered on its own merit without being prejudiced in any manner by this order.
