Petitioners are apprehending their arrest in connection with Baikunthpur PS Case No.252/18 , registered for offences punishable under 341, 323, 325, 354(B), 307, 34 of the Indian Penal Code.
As per FIR, petitioners are said to have torn Salwar of the informant, petitioner no.2 assaulted by Dab on head and when his son went to save her, he was also assaulted. Submission of the learned counsel for the petitioners is that there is case and counter case between the parties and there is delay of 196 days in lodging the FIR and no proper explanation has been given about that and as per the
Patna High Court CR. MISC. No.70997 of 2019(2) dt.18-11-2019 2/2 instruction, injury is also found to be simple in nature. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sri Niraj Kumar, J.M. Ist Class, Gopalganj in connection with Baikunthpur P.S.Case No.252 of 2018, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
