Petitioner seeks bail in a case registered for the offence punishable under section 366(A) of the Indian Penal Code read with Section 34 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. The present FIR has been lodged after three days of the alleged occurrence without there being any plausible explanation for the delay. From perusal of the statement under Section 164 of the C.r.P.C. of the victim, it appears that she herself left her house with this petitioner. Petitioner has no criminal antecedent. Petitioner is in custody since 28.08.2019.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.70074 of 2019(2) dt.18-11-2019 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Dehri, Rohtas in connection with Akorhi Gola P.S. Case No. 182/2019.
