2. Petitioner seeks regular bail in case registered for the offences punishable under Sections 103, 61 ( 2 ) and 111 of BNS and 27 of Arms Act.
3 . The prosecution case , in brief, is that informant namely , Birbal Singh alleged that on 24.07.2025 at about 09:00 PM, accused persons along with 10 others came at house of informant and forcibly took away his son and on 25.07.2025 , informant came to know that son of informant was killed.
4. Learned counsel for the petitioner submitted that at best it is a case of last seen . Informant is not an eye witness to the alleged occurrence . During course of investigation , the
Patna High Court CR. MISC. No.76044 of 2025(2) dt.18-11-2025 2/2 only material that has come against this petitioner is that on the order of this petitioner other accused killed son of informant. Petitioner is in custody since 26.07.2025 .
5 . Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts, materials available on record, period of custody , and other circumstances of the case , the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM Buxar in connection with Buxar Town P.
