JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-06-2018 Petitioner apprehends his arrest in connection with Bhagwanpur P.S. Case No. 14 of 2018 registered for the offences punishable under Sections 420, 406, 409 and 120B of the Indian Penal Code.

Allegation as per FIR is that there is defalcation in Bhagwanpur sub-Post Office of Rs. 92 lacs and at that time Anupam Kumar was the post master and petitioner has filed an informatory petition to the court below to that effect. Submission of learned counsel for the petitioner is that he is no way concern with the aforesaid defalcation and he has been made accused only on the basis of suspicion and another accused person has been given privilege of anticipatory bail vide order dated 4.6.2018 passed in Cr. Misc. No. 30271 of 2018.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, in the event of his arrest or surrender be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali, in connection with Bhagwanpur P.S. Case No. 14 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that he has to co-operate in the investigation otherwise his bail bond shall be cancelled.
