The petitioners apprehend their arrest in connection with Surajpura P.S. Case no. 47 of 2017, registered under Section 147, 148, 341, 323, 504, 379 and 307 of the Indian Penal Code and Section 27 of the Arms Act. The accusation is that on 13.04.2017 for attending the Coching class, informant Amit Kumar was going to Bikaramganj by bus. When he reached near the village Nonhar then some persons gave signal to stop the bus, thereafter, they entered in the bus and made inquiry about the informant and after identifying him they pull him from the bus. Thereafter, Dablu Kumar and petitioner No. 1 carried the informant
Patna High Court Cr.Misc. No.32315 of 2018(2) dt.14-06-2018 2/3 forcibly at their house. In the meantime, information was given to the family members then his family members reached there. At that time, petitioners and others started to commit Marpit and they also snatched golden chain from the neck of Kameshwar Singh and petitioner No.2 snatched Rs.2000/- from the pocket of Birendra Singh.
Learned counsel for the petitioners submits that, in fact, harvester of the petitioners was engaged by the family members of the informant for harvesting the crop of wheat, but after harvesting the crop of wheat and on demand money of fair was not paid and petitioner No.1 was assaulted regarding which petitioner No.1 lodged Suryapura P.S. Case No. 43 of 2017 on 09.04.2017 under Sections 341, 323, 324, 504 and 379/34 of the Indian Penal Code and only to save said case, the present case has been lodged.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Bikramganj, Rohtas in connection with Surajpura P.S. Case No. 47 of 2017,
