JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-07-2018 The petitioner seeks bail in anticipation of his arrest in connection with Islampur P.S. Case No. 110 of 2018, dated 04.04.2018, instituted for the offences punishable under Sections 379 and 431 of the Indian Penal Code, Section 4/40 of the Bihar Minor Mineral Act, 1972 and Section 8(d) of the Bihar Minerals Prevention of Illegal Mining Transportation & Storage Rule, 2003.
The petitioner is the driver of the vehicle in question which was found by the informant to have been loaded with sand in an unauthorized manner.
Learned counsel for the petitioner has submitted
Patna High Court Cr.Misc. No.32993 of 2018 (2) dt.02-07-2018 2/2 that in fact the sand was loaded on the vehicle against a valid chalan, but since the petitioner, after parking the vehicle, had gone to take his meal, the police party could not be intimated about the same.
The owner of the vehicle, it has been submitted, has been granted anticipatory bail.
Regard being had to the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Islampur P.S. Case No. 110 of 2018..
