2. Petitioners seek regular bail in connection with Kadwa P.S. Case No. 63 of 2024 dated 02.10.2024 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
3. Heard both the sides and perused the FIR.
4. The instant matter relates to the recovery of 513 litres of foreign liquor from a Tata Magic vehicle. Petitioners have taken the plea that the petitioner nos. 1 and 2 were present in the alleged vehicle in the capacity of driver and passenger respectively, at the alleged time of recovery having no
Patna High Court CR. MISC. No.80782 of 2024(3) dt.14-02-2025 2/2 knowledge of the seized liquor and both are having fair and clean antecedent and have been made accused merely on the basis of suspicion and they have not remained involved in an offence of the similar nature in the past.
5. Considering the petitioners' aforesaid pleas as well as their custody period and completion of investigation against them, this Court is inclined to release the petitioners on bail. Accordingly, let the petitioners named-above be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Kadwa P.S. Case No. 63 of 2024.
