SONI SHRIVASTAVA ORAL ORDER 22-04-2025 Heard learned counsel for the petitioners and learned APP for the State as well as learned counsel for the informant.

2. The petitioners apprehend their arrest in connection with Khizersarai P.S. Case No.162 of 2024 registered for the offences punishable under Sections 302, 201 and 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. The prosecution story as stated in the First Information Report is that the husband of the informant, namely, Sunil Kumar had gone to the field on 18.05.2024 and did not return and when the informant went in search she found that blood and bullet were lying at some distance and the dead body of her husband was found in the agricultural field of Ram

Learned counsel for the petitioners submits that the petitioners are the own sisters-in-law (Gotani) of the informant and their names have been taken by the informant in the FIR only on the ground of suspicion. As a matter of fact, the petitioners are residing in the same house and no suspicious activity is said to be reported.

5. Learned counsel further submits that the case entirely rests on suspicion on account of land dispute and there is no eye witness to the occurrence and further no suspicious material has been recovered from the house of these petitioners.

6. Learned APP for the State and learned counsel for the informant have opposed the prayer for anticipatory bail of the petitioners.

7. Taking into consideration the rival submissions of the parties and further taking into consideration that the petitioners who are females would not be expected even logically to participate in a crime like the one alleged and also taking into consideration the other submissions made on behalf of the petitioners and also considering that the petitioner no.1 is an Anganwari Sevika and the petitioner no.2 is a teacher with no criminal antecedents, I am inclined to extend the privilege of

Let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned 18th Additional Sessions Judge, Gaya in connection with Khizersarai P.S. Case No.162 of 2024, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. and subject to the further condition that the petitioners shall cooperate in the investigation/trial.
