JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Paroo P.S. Case No. 240 of 2019 registered for the offences punishable under Sections 384, 385 of the Indian Penal Code and Sections 25(1-B)(a), 26 and 35 of the Arms Act. As per FIR there is allegation the accused persons, including the petitioner that they demanded Rs.2 lac as extortion from the informant and they tried to snatch motorcycle of his son. It is further alleged that while informant along with his family members were going to attend marriage of daughter of one Md. Sallauddin one Md. Ezaz along with petitioner came with a pistol and seeing the police party petitioner fled away but Md. Ezaz was apprehended by the police.

Submission of learned counsel for the petitioner is that he is co-villager of the informant working in Saudi and

Patna High Court CR. MISC. No.70308 of 2019(2) dt.07-11-2019 2/2 present case has been lodged in order to abstract money from him when he came to his village and there is no specific allegation against him.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, (West) Muzaffarpur, in connection with Paroo P.S. Case No. 240 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
