The petitioner is seeking anticipatory bail in connection with Karja P.S. Case No. 173 of 2018 registered under Sections 399, 402, 414, 279 and 427 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case just to harass him, there are some contradictions in the story as alleged in the First Information Report.
Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner.
Considering the facts and circumstances of the case wherein learned counsel for the petitioner has demonstrated
Patna High Court CR. MISC. No.69742 of 2019(3) dt.13-12-2019 2/3 before this court that there are some contradictions in the story as alleged in the F.I.R.
and in the further statement of the informant where he has recorded that the Car which met with an accident was surrounded by police personnel and two persons were arrested from that Car but has not stated that three other persons were also there who fled away and/or those two persons disclosed the name of this petitioner, even though this court finds that petitioner has got some criminal antecedent, in the nature of the materials which have been brought before this court, this court is inclined to grant anticipatory bail to the petitioner, let the above-named petitioner, in the event of his arrest/surrender before the court below within a period of four weeks, be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.
- 2nd West, Muzaffarpur, in connection with Karja P.S. Case No. 173 of 2018, subject to condition as laid down under Section 438(2) of the Cr.P.C. i.e.
(i) a condition that the person shall make himself available for interrogation by a police officer as and when required;
(ii) a condition that the person shall not, directly or
