2. The petitioner has prayed for bail in a case registered for the offence punishable under Sections 103(1) and 61(2) of BNSS and under Section 27 of the Arms Act.

3. The case of the prosecution is that the informant was married to Amroz Alam four years ago. After marriage, the father-in-law and mother-in-law of the informant started quarreling and assaulted the informant due to which the husband of the informant started living separate with his wife from his parents. It is alleged that two days prior to the occurrence, five persons have threatened to kill the husband of the informant.

4. Learned counsel appearing on behalf of the petitioner has submitted that the name of this petitioner is not in

Patna High Court CR. MISC. No.81357 of 2024(4) dt.28-02-2025 2/2 the FIR. His name has surfaced in the confessional statement of the co-accused Imdadullah. Imdadullah has named this petitioner. No recovery has been made leading to the confessional statement. There is nothing except confessional statement of the co-accused against this petitioner. The petitioner is having no criminal antecedent and he is in jail since 25.08.2024.

5. The application for bail is opposed by learned APP for the State as well as by the learned counsel for the informant.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court of A.C.J.M., 1st Class, Araria in connection with Raniganj P.S. Case No. 383 of 2024.

7. Accordingly, the present bail application stands allowed.
