Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 333, 329(4), 126(2), 115(2), 76, 303(2), 352, 351(2)(3), 3(5) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioners submits that the petitioner Nos. 1 and 2 have antecedent of one case under the Excise Act and petitioner No. 3 is a person with clean antecedent and are brothers. It is next submitted that the informant alleges that petitioners entered her house and acted

Patna High Court CR. MISC. No.76514 of 2025(2) dt.01-12-2025 2/3 inappropriately and disrobed her, on alarm she was assaulted and the accused fled after snatching Rs. 5,000 as well as her earring.

Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that date of occurrence is 108-2025 and the FIR came to be instituted on 15-8-2025, i.e., after a delay of five days without any plausible explanation. It is also submitted that husband of the informant, namely, Kundan Singh, had shot the father of the petitioners for which Alamnagar PS Case No. 259 of 2025 was instituted by the side of the petitioners, as such the instant FIR is a counter-blast. 5.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with
