The petitioner apprehends his arrest in Katihar P.S. Case No. 280/2018, registered for the offences punishable under Sections 307, 506, 504 and 34 of the Indian Penal Code and section 27 of the Arms Act.
The informant alleged that the petitioner and two unknown persons came on a motorcycle and abused the informant. The petitioner is alleged to have fired, but the informant somehow saved his life.
Learned counsel for the petitioner submits that informant is labor of a firm. On account of arrears of wages, some dispute arose between the petitioner and the informant that is why the informant lodged this false case. The petitioner also filed
Patna High Court Cr.Misc. No.39923 of 2018 (2) dt.10-07-2018 2/2 complaint case No. 1003/2018 against the informant, but it appears that there is specific allegation against the petitioner that he made indiscriminate firing. Two live cartridges were also recovered from the place of occurrence. Witnesses also reiterated the facts. The petitioner filed complaint case after one week of the institution of the case by the informant.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
