2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 109 and 61(2) of the Bharatiya Nyaya Sanhita and under Section 27 of the Arms Act in which ssubsequently Sections 25(1-b)a & 26 of the Arms Act was added vide order dated 07.05.2025.

3. The case of the prosecution in short is that while the informant was returning with his father on bike, as he reached near SBI ATM in Shivganj, he felt pain in his chest in left side. He stopped his bike and found that there was bleeding from his chest from left side. He did not found anybody there. He was brought to Sadar Hospital.

4. Learned counsel for the petitioner has submitted that the name of this petitioner has surfaced during investigation

Patna High Court CR. MISC. No.76483 of 2025(2) dt.19-11-2025 2/2 on secret information and on the basis of secret information the petitioner was apprehended and he has given his confessional statement. Save and except the confessional statement, nothing is there. Only a country made pistol has been recovered from the possession of the petitioner. The petitioner is in custody since 07.05.2025.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner and has submitted that the petitioner is having criminal antecedent of one case.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Town P.S. Case No. 293 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara.
