JUSTICE SANJAY PRIYA ORAL ORDER 16-07-2018 Heard learned counsel for the petitioner, learned counsel for the opposite party No. 2 and the State. The petitioner apprehends his arrest in Complaint Case No. 1529(C) of 2016 instituted for the offence under Sections 420, 504 of the Indian Penal Code and Section 138 of N.I.T. Act.

It is alleged that petitioner took Rs.2,33,000/- from the complainant in his account on pretext to get job to his son. The complainant also paid Rs.65,000/- in cash to the petitioner. It is further alleged that complainant made demand of his money when his son could not get job, then petitioner gave a cheque of

Patna High Court Cr.Misc. No.41221 of 2018 (2) dt.16-07-2018 2/2 Rs.7,000/- to the informant and when aforesaid cheque was presented in the Bank, the same bounced.

Learned counsel for the opposite party No. 2 during hearing of the bail petition has submitted that he has paid an amount of Rs.2,33,000/- to the petitioner. He has filed the receipt showing payment of aforesaid amount to the petitioner. He has also submitted that cheque of Rs.7,000/- issued by the petitioner get bounced.

Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail.
