JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Maranchi P.S. Case No. 97 of 2019, arising out of Special Case No. 7831 of 2019, registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

As per FIR 4 litres of liquor has been recovered from the house of petitioner No.1 and 14 litres of liquor has been recovered from the house of petitioner No.2. It further appears that petitioner No.1 has criminal antecedent and he is accused in similar type of case.

Heard learned APP, who has opposed the prayer for anticipatory bail stating that there is recovery of liquor from the houses of the petitioners and petitioner No.1 has criminal antecedent also, as such this application is not maintainable. In view of above facts and circumstances, this application is disposed of with direction to the petitioners to surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.
