The petitioner apprehends his arrest in a case registered for the offence punishable u/s 147, 148, 149, 341, 342, 323, 337, 353, 307, 171(c), 153(A), 120(B) of IPC, [u/s 191(2),191(3), 190, 126, 127, 115(2), 125, 132, 109, 196, 171, 61(2) of BNS, 2023]and Section 27 of Arms Act.

Allegedly, petitioner along with other co-accused persons are said to have pelted bricks and stone on the police vehicle and they also fired upon them.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. The allegation

It is further submitted that similarly situated co-accused person has been granted anticipatory bail by this Court vide order dated 21.10.2024 passed in Cr. Misc. No. 70230 of 2024. Petitioner has two criminal antecedent as mentioned in para 3 of the bail application.

Learned APP for the State opposed the prayer for bail. 6.

Having regard to the facts and circumstances of the case, and the fact that similarly situated co-accused person has been granted bail by this Court, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Bihar P.S. Case No.334 of 2024, subject to the conditions as laid down under Section 482(2) of the BNSS, 2023.
