Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Complaint Case No. 202 of 2018, registered for offences under Sections 323, 504, 341, 498A, 316, 506 and 379 of the Indian Penal Code and Section 3/4 of the D.P. Act.

It has jointly been submitted that the matter has been compromised. As per terms and conditions of compromise, the petitioner was to pay Rs. 3,500,00/- to opposite party no. 2, of which Rs. 1,00,000/- has already been paid and today the learned counsel for the petitioner is handing over a draft of Rs. 2,50,000/- in favour of opposite party no. 2, Salma Praveen. It

Patna High Court CR. MISC. No.72894 of 2019(9) dt.26-09-2022 2/2 is also agreed between the parties that the petitioner shall deposit Rs. 4,50,000/- in fixed deposit in favour of the minor daughter of the couple, Saniya Praveen and the maintenance case as per terms and conditions of the compromise is to be withdrawn by opposite party no. 2.

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Sherghati, Gaya in connection with Complaint Case No. 202 of 2018/Tr. No. 1751/18 subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
