JUSTICE SANDEEP KUMAR ORAL ORDER 01-03-2024 This is the second attempt of the petitioner for grant of regular bail as earlier the bail application of the petitioner was rejected vide order dated 22.05.2023 passed in Cr. Misc. No. 21657 of 2023.

2. Heard learned counsel for the petitioner and learned APP for the State Shri Madan Kumar.

3. The petitioner seeks bail in connection with Gopalpur P.S. Case No. 182 of 2021 registered for the offence under Sections 302/120B/34 of the Indian Penal Code and under Section 27 of the Arms Act.

4. It has very fairly been submitted by the learned senior counsel appearing for the petitioner Shri Y.C. Verma that the trial has commenced and some witnesses have already been examined.

5. Learned senior counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case and he is in jail since 17.08.2022.

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the aforesaid facts, this Court is not inclined to grant bail to the petitioner.

8. Accordingly, this application is dismissed.

9. The trial Court is directed to conclude the trial at the earliest.
