2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 302 of the Indian Penal Code.
3. The case of the prosecution is that on 23.06.2020, informant's father after taking meal went to sleep on the cot in front of the 'bathan' by the roadside. On 24.06.2020, when the informant went to see his father, he found that his father was was laying down in the field. It is further alleged that informant's father used to keep a torch with a rope tied to it. It is further alleged that some unknown criminals killed his father by strangulating him. Subsequently, the police were informed.

During the course of investigation, after thirty days of this FIR, the informant has given an application before the Senior Superintendent of Police wherein he has alleged that prior to the occurrence, there was dispute between the parties and that the petitioner and his family members have threatened the father of the informant of dire consequences. On this basis, the name of the petitioner has come in this case.
5. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It has further been submitted that on perusal of the entire case diary, it transpires that there is not a single independent witness has supported the prosecution story except the application which has been filed after 30 days of lodging of the FIR. Petitioner has been implicated in this case on mere suspicion. Moreover, the petitioner is languishing in judicial custody since 29.08.2024 having no criminal antecedent.
6. Learned APP appearing for the state has opposed the prayer of regular bail.
7. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on
Patna High Court CR. MISC. No.81247 of 2024(4) dt.17-03-2025 3/3 bail. The above named petitioner is directed to be released on bail in connection with Maniyari P.S. Case No. 153 of 2020 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Muzuffarpur.
