2. The petitioner has prayed for bail in connection with Kutumba P.S. Case No.145 of 2024 registered for the offence punishable under Sections 30(a), 36 and 34 of the Bihar Prohibition and Excise Act.

3. The case of the prosecution is that altogether 4000 liters of sprit was recovered from a Truck bering registration No. BR02T-2336.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He is the driver and he has got no concern with the seized

Patna High Court CR. MISC. No.80757 of 2024(3) dt.03-03-2025 2/2 material. Petitioner is having no criminal antecedent as submitted by learned counsel for the petitioner. He is languishing in judicial custody since 04.09.2024.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise 1st, Aurangabad, Bihar in connection with Kutumba P.S. Case No. 145 of 2024 with a condition that the learned trial Court shall verify the criminal antecedent of the petitioner before releasing him and if it is found that the petitioner has any criminal antecedent then his bail bonds will be cancelled.
