JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-12-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 302 of the Indian Penal Code. Petitioner happens to be the husband of the deceased and there is specific allegation that he committed murder of deceased by pressing her neck. The postmortem report goes to show that the cause of death was asphyxia due to suffocation in case of blockage of nose and mouth by hand. Admittedly, the deceased died inside her house.

Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail.
