JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-07-2018 Heard the parties. The petitioners seek anticipatory bail in connection with Shambhuganj P.S. Case No.112 of 2018, registered for offences punishable under Section 341, 323, 307, 384, 385, 386, 504/34 of the Indian Penal Code.
As per F.I.R., allegation against the petitioners is that the petitioners along with one another person intercepted the vehicle of the informant and co-accused person was on the point of pistol asked him that why he was not paid ransom and petitioner No. 2 assaulted him with fist and slaps and again they have surrounded him and assaulted with knife blow, which hit on the left eye brow, causing cut injury and further petitioner No. 2 snatched Rs. 26,000/- case from his pocket.
Patna High Court Cr.Misc. No.41897 of 2018 (2) dt.19-07-2018 2/2 Submission of the learned counsel for the petitioners is that they have falsely been implicated in this case and petitioner No. 1 is the husband of Mukhiya and the informant is the husband of Pramukh of the said Panchyat. It is also submitted that the petitioners have clean antecedents.
Learned A.P.P. opposes the prayer for bail.
ving heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of the order, be released on anticipatory bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each in connection with Shambhuganj P.S. Case No.112 of 2018 to the satisfaction of learned Chief Judicial Magistrate, Banka subject to the conditions as laid down under Section under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
