2 The petitioner has preferred this application for grant of regular bail in connection with Marhowrah PS Case No 33 of 2023 dated 22.01.2023 registered for the offence punishable under Sections 147, 149, 341, 323, 324, 307, 506/34 of the IPC.

3 As per the prosecution case, the petitioner and the co-accused persons armed with daab and iron rod assaulted the informant and his family members. The injured family members were taken to the Hospital for treatment. 4 Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this

Patna High Court CR. MISC. No.80322 of 2023(3) dt.29-02-2024 2/2 case due to village politics. There is general and omnibus allegation against the petitioner. Nothing incriminating material has been recovered from the conscious possession of the petitioner. The petitioner has got clean antecedent as stated in paragraph 3 of the bail petition and is in custody since 06.08.2023. Co-accused persons, namely, Sushila Devi and Gajendra Rai @ Gajendra Kumar have already been granted bail by coordinate Benches of this Court in Cr Misc No 35241 of 2023 and Cr Misc No 41850 of 2023 respectively (Annexure 4 series).

5 Learned APP for the State has vehemently opposed the bail petition of the petitioner.

6 Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above named is directed to be released on bail on his furnishing bonds of Rs 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of CJM, Saran at Chapra in Marhowrah PS Case No 33 of 2023.
