The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,307 and 374/34 of the IPC.
The prosecution case as per the written report of Vinod Kumar Singh dated 4.3.2018 submitted to the SHO, Durgawati Police Station is to the effect that on the same day at 11.30 A.M. the elder brother of the informant, namely, Ashok Kumar Singh was driving to Tata but the miscreants blocked the road and snatched the gold chain and Rs.42,500/- from the brother of the informant. When the informant tried to pacify the issue, the miscreants assaulted the informant causing bleeding injury. The informant claims to have identified the miscreants named in the written report.

No.39738 of 2018(2) dt.10-07-2018 2/2 It is submitted by learned counsel for the petitioner that only one lacerated injury has been found superficial simple in nature caused by hard and blunt substance. It is further submitted that there is no recovery from the petitioner and statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that the petitioner is named in the FIR.
Considering the nature of accusation, particularly, the accusation not being corroborated by the medical opinion, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Kaimur at Bhabua in connection with Durgawati P.S. Case No.77 of 2018 subject to the conditions laid down in Section 438(2) of the Cr.P.C.
