JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 25-07-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has renewed the prayer for anticipatory bail in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code. The accusation is of killing the daughter of the informant after eight months of the marriage for non-fulfillment of the dowry demand.

The prayer for anticipatory bail of the petitioner was earlier rejected vide order dated 15.10.2015 passed in Cr. Misc. No. 42828 of 2015. Now the prayer has been renewed on the ground that in split up trial of other accused persons informant has not supported the prosecution case and stated that

Patna High Court Cr.Misc. No.42807 of 2018 (2) dt.25-07-2018 the victim was earlier married with someone else and her dead body was recovered from a well situated near the house of her first husband. Petitioner is the second husband of the victim. Moreover, the victim was at her parents' house when she went traceless. Considering the fact that the earlier anticipatory bail application of the petitioner was rejected in 2015 and the prayer has been renewed in 2018 when other family members of the petitioner are facing trial and the petitioner still has not appeared, this Court is not inclined to revise the earlier order.

Accordingly, the prayer for anticipatory bail of the petitioner is again rejected in connection with Jhajha P.S. Case No. 28 of 2014, pending in the Court of learned Sub-divisional Judicial Magistrate, Jamui.
