JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-07-2018 Heard learned counsels for the petitioner and State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419, 420, 467, 468, 471 and 420 of the IPC.
The prosecution case, as per the written report of District Agriculture Officer, Patna dated 21.12.2017, submitted to the Station House Officer, Jakkanpur Police Station to the effect that one Binay Kumar Singh submitted a requisition seeking some information under R.T.I., Act. During course of providing the information, it was found that the petitioner, Manoj Singh on the basis of forged educational certificates and documents of one Yashwant Kumar Singh, served on the post of SubjectMatter Specialists from 05.05.2010 to 15.05.2013.

No.43717 of 2018(2) dt.24-07-2018 2/3 It is submitted by learned counsel for the petitioner that the investigation of the case is still pending, however, the petitioner is ready to return the amount to the tune of Rs. 4,74,903/-, which has been paid as salary to him in lieu of working as Subject Matter Specialists within a period of six months in six equal installments. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.
Learned APP submits that accusation is specific against the petitioner.
Considering the fact that the petitioner is ready to return the amount to the tune of Rs. 4,74,903/- within a period of six months in six equal installments, and the investigation has not concluded as yet, let the above named petitioner be released on provisional anticipatory bail for six months in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Sub-Judge-I-cum-ACJM, Patna in connection with Jakkanpur P.S. Case No. 432 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C. The provisional bail of the petitioner will be confirmed by

The above mentioned amount will be deposited in some fix deposit scheme in connection with the present case, by the learned Court below, which will be subject to the result of the present case.
