At the outset, learned counsel for the petitioners submit that during pendency of this petition, the petitioner Nos. 1 and 2 have already been arrested and as such, these application has become infructuous .

Accordingly, this application against petitioner Nos. 1 and 2, is dismissed as same has become infructuous. The petitioner No. 3 seeks anticipatory bail in connection with Jamo Bazar P.S. Case No.92 of 2017, registered for offences punishable under Sections 304B/201/120B/34 of the Indian Penal Code.

As per F.I.R., allegation against the petitioner No. 3, who is brother-in-law of the deceased, is an accused of dowry

Patna High Court Cr.Misc. No.42125 of 2018 (2) dt.19-07-2018 2/2 death.

Submission of the learned counsel for the petitioner is that there is no specific allegation has been attributed against the petitioner and deceased died due to diarrhea, while she was being taken to hospital.

Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner No. 3, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of the order, be released on anticipatory bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each in connection with Jamo Bazar P.S. Case No. 92 of 2017 to the satisfaction of learned A.C.J.M-XIII, Siwan subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
