The petitioner in this case is seeking anticipatory bail in connection with Biraul P.S. Case No. 183 of 2019 registered for the offences punishable under Sections 323, 324, 379, 307/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that there is a case and counter case in terms of Annexure '2' to the present application and the injury is simple in nature. Learned APP for the State is present and has opposed the prayer for anticipatory bail of the petitioner. Considering the facts and circumstances of the case that there is a specific allegation of giving a knife injury on the chest of the informant is against this petitioner, this Court is not

Patna High Court CR. MISC. No.71085 of 2019(2) dt.11-12-2019 2/2 inclined to grant anticipatory bail to the petitioner. His prayer is refused.

In case petitioner surrenders and prays for regular bail in the court below within a period of four weeks from today, his prayer for regular shall be considered on its own merit without being prejudiced by the order of this Court.
