Petitioner is apprehending his arrest in connection with Hajipur Town P.S. Case No.07/2023, registered for the offence punishable u/s 420, 467, 468, 470, 471, 120(B)/34 of the IPC. 3.

Allegation against the petitioner is that he along with other co-accused persons sold the land of the informant's grand father after impersonating some other person as his late grandfather namely Tribhuvan Singh and by creating his forged documents.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence. He has been falsely implicated in this case merely on suspicion. No such occurrence in the manner as alleged has ever taken

Patna High Court CR. MISC. No.82137 of 2023(2) dt.04-01-2024 2/2 place. It is submitted that as per the F.I.R., there is no specific allegation against the petitioner. One of the co-accused has been granted anticipatory bail by the co-ordinate Bench of this Court. Petitioner has three criminal antecedent.

Learned APP for the State opposed the prayer for bail. 6.

Considering the aforesaid facts and circumstances of the case and on perusal of the record, it transpires that the petitioner has been instrumental in impersonating some other person as Tribhuvan Singh (who has already died). Further, it is specifically alleged that he is involved in the sale of the said land and also considering his criminal antecedent, in similar nature of offence, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected.

This application is accordingly dismissed.

However, petitioner is at liberty to surrender before the learned Court below within a period of six weeks and seek regular bail and the learned Court below would pass order, preferably, on the same day, in accordance with law. (Anjani Kumar Sharan, J) pallavi/- U T
