The petitioner is apprehending his arrest in connection with Supaul P.S.Case no.136 of 2018 , registered for offences punishable under Sections 366(A)34 of the Indian Penal Code. Allegation against the petitioner is of kidnapping the minor daughter of the informant.
Submission of the learned counsel for the petitioner is that he is not named accused in this case rather his name transpired in the re-statement of the informant and further no specific allegation has been attributed against him.
Heard learned A.P.P. and the learned counsel for the informant..
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.42671 of 2018 (2) dt.24-07-2018 2/2 circumstances, as stated above, let the petitioner surrender before the court below within a period of six weeks from the date of receipt of the order and on surrender he will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Supaul in connection with Supaul P.S.Case no.136 of 2018 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that he has to appear before the Investigating Officer as and when required and co-operate in the investigation till recovery of the girl.
