The petitioner seeks pre-arrest bail in connection with Sikandra P.S. Case No.129 of 2017 registered under Sections 363 and 365 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the petitioner who is aged about twenty five years along with five others went to Chennai in order to search job and there they worked for some time and subsequently came back. It is further submitted that there is no truth behind the allegation that the petitioner was in any way instrumental in providing job to the victim or confining him illegally at any point of time. It is further contended that the petitioner has no criminal antecedent and

Patna High Court Cr.Misc. No.42908 of 2018 (2) dt.19-07-2018 2/2 having got roots in the society, he is not likely to abscond or tamper with the evidence.

Learned counsel for the State has opposed the prayer for grant of pre-arrest bail to the petitioner. He submitted that on return the victim has made his statement under Section 164 of the Code of Criminal Procedure in which he has named the petitioner as one of the persons who handed over the victim to some unknown person who had taken work from him as a bonded labour.

Keeping in mind the facts and circumstances of the case, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Sikandra P.S. Case No.129 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) Md.S./- U T
