The petitioner seeks bail in connection with Mahua P.S. Case No.304 of 2023 registered for the offence punishable under Sections 302 and 120-B/34 of the Indian Penal Code.

The deceased was killed by unknown criminals. The petitioner is in custody since 20.06.2023. 4.

Learned counsel for the informant has opposed the prayer for bail by submiting that the petitioner has threatened the informant.

Considering the fact that there is no materiel against the petitioner to connect him with the crime, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Vaishali at Hajipur, in connection with Mahua P.S. Case No.304 of 2023, subject to the condition that he will cooperate in the trial. 7.

Considering the allegation of threat, it is directed that the petitioner will mark his attendance in Mahua Police Station, District- Vaishali on each and every Sunday of the month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioner. 8.

It is needless to say that in case of any further threat, the informant may move directly before this Court for cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) pawan/- U T
