The petitioner has filed the instant application for grant of bail in connection with Chapra Mufassil P.S. Case No. 353 of 2019 (District Chapra) registered for the offence punishable under sections 272 and 273 of the Indian Penal Code and sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act, 2016.
As per the allegation in the FIR, the petitioner made an unsuccessful attempt to escape and on search it is stated that 14 litres of country liquor was recovered from his motorcycle. It is submitted by learned counsel for the petitioner that the allegation of recovery is false and concocted. The petitioner has no criminal antecedent and is in custody since

The application for bail has been opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the petitioner being in custody since 14.09.2019, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Saran at Chapra in connection with Chapra Mufassil P.S. Case No. 353 of 2019 (District Saran at Chapra).
