JUSTICE SANJAY PRIYA ORAL ORDER 2/ 25-07-2018 This application has been filed for modification of the order dated 03.07.2018 passed in Cr. Misc. No.36477 of 2018 by which petitioner has been granted anticipatory bail in connection with Jogbani (Bathnaha) P.S. Case No.70 of 2014 to the satisfaction of 3rd Additional District & Sessions Judge, Araria.

Counsel for the petitioner submits that due to inadvertence in the main bail petition, „3rd Additional District & Sessions Judge, Araria‟, was typed, in place of "Additional Chief Judicial Magistrate, 1st, Araria," and the same mistake has occurred in the order dated 03.07.2018 passed in Cr. Misc. No.36477 of 2018 by which petitioner has been granted anticipatory bail.

Counsel for the petitioner is permitted to make necessary correction in the main bail petition with regard to name

Patna High Court Cr.Misc. No.43930 of 2018 (2) dt.25-07-2018 2/2 of the Court.

Accordingly, in the order dated 03.07.2018 passed in Cr. Misc. No.36477 of 2018, in place of „3rd Additional District & Sessions Judge, Araria,‟ it should be read as "Additional Chief Judicial Magistrate, 1st, Araria".

The order dated 03.07.2018 passed in Cr. Misc. No.36477 of 2018 stands modified to the aforesaid extent. Two weeks‟ further time from the date of receipt of copy of this order is granted to the petitioner to surrender before the Court below and he will be released on same terms and conditions as mentioned in the order dated 03.07.2018 passed in Cr. Misc. No.36477 of 2018, This Modification Application is, accordingly, allowed.
