2. In the present case, the petitioner seeks bail in connection with Tetiya Bamber P.S. Case No. 38 of 2024, dated 20.06.2024, registered for the offences punishable under Sections 323, 341, 325, 307, 504, 506 and 34 of the Indian Penal Code.

3. As per prosecution case, in the background of grazing of the crop of the petitioner, the petitioner assaulted the cattle of the informant. When the husband of the informant scolded him, the petitioner and other co-accused persons armed with sabbal, iron rod and lathi and assaulted the informant and her family members causing a number of injuries to them.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. No occurrence in the manner as alleged as ever taken place. The F.I.R. has been lodged after delay of four days and there is no explanation for the same. The injuries of informant and one Soni Devi are found to be grievous due to fracture, but they are not sharp cut injuries and injuries of other persons are found to be simple in nature. Informant side was aggressor and due to land dispute they assaulted the petitioner first. A free fight took place and both sides sustained injuries including the petitioner. Petitioner has clean antecedent and he is in custody since 29.08.2025 and charge-sheet has been submitted.

5. Learned APP for the State vehemently opposed the prayer for bail of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody and submission of charge-sheet, the petitioner above-named, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rs. Ten Thousand Only) with two sureties of the like amount each to the satisfaction of court of learned Chief Judicial Magistrate, Munger, in connection

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial Court.

(iii) In case of non-appearance of the petitioner on single date or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the Court concerned.
