2. The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 323, 307, 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. It is alleged that while informant was going home, the accused persons including this petitioner assaulted him.
4. It is submitted on behalf of petitioner that specific allegation of causing fire-arm injury is against co-accused. So far as this petitioner is concerned, he is only alleged to have assaulted the son of the informant by fists & slaps. There is long standing land dispute between the parties. Allegation of assault is general and omnibus and no specific overt act has been alleged against this petitioner. Petitioner has got clean antecedent.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - III, Katihar in connection with Barari P.S. Case No. 226 of 2023 (G.R. No. 3922 of 2023), subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
