Case No. 7161 of 2019 arising out of Patna Jn. P.S. Case No. 447 of 2019 registered for the offence punishable under Section 30(a) of Bihar Excise Act.

Prosecution case disclosed recovery of 76 liter of illicit liquor from the petitioner when he was arrested at plateform of Patna Junction.

Submission of learned counsel for the petitioner is that he was arrested on the basis of suspicion and nothing has been recovered from his possession. He is in custody for more than three months having no criminal antecedent and there is no chance of tempering with the evidence.

Having heard both sides, in view of the facts and

No.72813 of 2019(2) dt.11-12-2019 2/2 circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Spl. Judge, Excise, Patna in connection with Spl. Case No. 7161 of 2019 arising out of Patna Jn. P.S. Case No. 447 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with the condition to co-operate in disposal of the trial.
